1. General Terms

1.1 Acceptance of Terms

By using the Brick Lab website (www.SVBrickLab.com) or enrolling in any program or service offered by Brick Builds Co. DBA Brick Lab (“Brick Lab”), you (“Client,” “Parent,” or “Guardian”) agree to be bound by these Terms and Conditions (“Terms”). If you are enrolling a minor in a program, you represent that you are the parent or legal guardian of that minor and have full authority to agree to these Terms on their behalf.

1.2 Modification of Terms

Brick Lab reserves the right to update or modify these Terms at any time. Updates will be posted on our website at www.SVBrickLab.com. Continued use of the Site or enrollment in any program after changes are posted constitutes acceptance of the revised Terms. Clients may request a printed copy of the current Terms by contacting us at BrickLabTeam@SVBrickLab.com.

1.3 Legal Entity

All programs and services are operated by Brick Builds Co., a California business entity doing business as Brick Lab. The name "Brick Lab" is used throughout these Terms for clarity and familiarity. References to "Brick Lab," "we," "us," or "our" refer to Brick Builds Co. and its authorized staff and representatives.

1.4 Not a Childcare Provider

IMPORTANT: Brick Lab is an educational enrichment and activity program provider. Brick Lab is not a licensed childcare facility, daycare center, or childcare service of any kind. Our programs are structured, time-limited educational and creative enrichment experiences. Enrollment in any Brick Lab program does not constitute a childcare arrangement. Parents and guardians are responsible for their children outside of scheduled program hours and at all times during programs where adult supervision is required (see program-specific terms below).

Brick Lab staff do not provide transportation to or from programs (except for disclosed, supervised walks as part of camp programming — see Section 5.2), and do not provide restroom assistance. Staff will not accompany participants into restroom facilities.

1.5 Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of California. Any disputes arising under or related to these Terms shall be resolved through binding arbitration in Santa Cruz County, California, in accordance with the rules of a mutually agreed-upon arbitration body. Nothing in this section prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction.

1.6 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

1.7 Entire Agreement

These Terms, together with any program-specific agreements (such as the Birthday Party Service Agreement), constitute the entire agreement between Brick Lab and the Client regarding the use of Brick Lab's services. In the event of a conflict between these Terms and a program-specific agreement, the program-specific agreement shall control with respect to that program.

2. Enrollment & Payment

2.1 Enrollment

Enrollment in all Brick Lab programs is completed through the Brick Lab website at www.SVBrickLab.com. Enrollment is not confirmed until full payment (or the required deposit, where applicable) has been received. Brick Lab reserves the right to deny enrollment at its sole discretion.

2.2 Payment

Payments are accepted via credit card through the Brick Lab website or by check made payable to Brick Builds Co.
An invoice or payment schedule will be issued for programs requiring deposits or installment payments.
Failure to complete payments in accordance with the applicable payment schedule may result in cancellation of enrollment without refund of amounts already paid.

2.3 Late Enrollment & Prorating

Clients may enroll after a multi-session program has begun, subject to availability.
Prorated rates are calculated based on the number of sessions remaining at the time of enrollment.
The prorated rate for after-school programs is $50 per 90-minute session, unless otherwise specified.

2.4 Gift Cards

Brick Lab gift cards are available for purchase at www.SVBrickLab.com.

Gift cards may be applied to any Brick Lab program or service, with no restrictions.
Gift cards do not expire and have no cash value.
Lost or stolen gift cards cannot be replaced.
Gift cards are non-refundable once purchased.

3. Cancellation & Refund Policy

All cancellations must be submitted in writing by email to BrickLabTeam@SVBrickLab.com. Refunds or credits are issued only upon receipt of written notice within the applicable notice period. Cancellations made verbally or via social media are not accepted. The following table summarizes the cancellation and refund policy by program type.

After-School Classes
14+ days before program start: Full refund or 100% credit
7–13 days before program start: 50% refund or 100% credit
Less than 7 days / after program begins: No refund. 50% discount code toward a future program of equal or lesser value, at Brick Lab's discretion

Camps
14+ days before camp start: Full refund or 100% credit
7–13 days before camp start: 50% refund or 100% credit
Less than 7 days / after camp begins: No refund. No credit.

Single-Session Events (PNO, Community Build Night, Robotics)
72 hours before event: Full refund
Less than 72 hours before event: No refund. Credit toward a future event, at Brick Lab's discretion.

Birthday Parties & Private Events
14+ days before event: Refund of refundable deposit portion (25% of total fee)
7–13 days before event: 50% of refundable deposit portion
Less than 7 days before event: No refund

Memberships
After program begins: No refund on membership fee. Standard session rates apply for remaining sessions.

Credits issued under this policy are valid for 12 months from the date of issuance and may be applied toward any eligible Brick Lab program.

4. General Program Terms

4.1 Attendance

Regular attendance is encouraged for all multi-session programs.
Missed sessions are not eligible for refunds, credits, or make-up sessions unless otherwise stated in the program description.
Excessive or unexplained absences in after-school programs may result in forfeiture of enrollment without refund, at Brick Lab's discretion.

4.2 Participation Policy

All Brick Lab programs include hands-on, STEAM-focused activities including guided builds, creative challenges, and collaborative projects. Participation in structured activities is encouraged but never required.

Participants who prefer a different pace may engage in alternative LEGO®-themed activities such as coloring, books, or quiet creative play, at staff discretion.
Brick Lab's priority is creating a safe, positive, and inclusive environment where all participants feel respected and supported.

4.3 Code of Conduct

All participants, parents, and guardians are expected to treat Brick Lab staff, fellow participants, and the facility and its materials with respect.

Disruptive, unsafe, or disrespectful behavior — including aggressive language, physical aggression, or deliberate damage to materials — may result in immediate dismissal from the program without refund.
Parents and guardians may also be asked to leave the premises if their behavior is disruptive or threatening to staff or other participants.
Brick Lab reserves the right to decline future enrollment to any participant or family following a conduct-related dismissal.

4.4 Support & Accessibility Policy

Brick Lab strives to create an inclusive environment where all participants feel welcome. However, Brick Lab is not a therapeutic or behavioral intervention program and is not staffed or trained to provide one-on-one behavioral support.

If a participant requires an aide or additional support during the school day, the same level of support must be provided during their time at Brick Lab, at the family's expense.
Aides must be adults (18+), non-family members, and must provide evidence of a cleared fingerprint background check and TB clearance at the family's expense.
If the aide is currently employed by the school district and has completed the required clearances in that capacity, Brick Lab will waive this requirement upon verification.
Aides must be present for the full duration of the program session and must be approved by Brick Lab staff in advance.

4.5 Late Pick-Up Policy

All participants must be picked up promptly at the scheduled end time of their program.

A late pick-up fee of $1.00 per minute may be charged for pick-ups more than 10 minutes after the scheduled program end time, at the discretion of Brick Lab staff.
This policy applies to all programs including after-school classes, camps, Parent's Night Out, and Robotics Build Club. It does not apply to Lego® Lounge, which operates on a self check-in/check-out basis (see Section 5.8).
Repeated late pick-ups may result in the participant being disenrolled from the program.
If a parent or guardian cannot be reached and a participant remains uncollected for an extended period, Brick Lab staff will attempt to contact the emergency contact on file. If no contact can be reached within a reasonable time, Brick Lab staff will contact local authorities.

4.6 Emergency Contact & Medical Consent

Emergency contact information is required at enrollment for all drop-off programs.
By enrolling a participant in a Brick Lab program, the parent or guardian authorizes Brick Lab staff to seek emergency medical treatment for the participant if necessary and if the parent or guardian cannot be reached.
Brick Lab staff will make every effort to contact the parent or guardian in the event of a medical situation before seeking outside assistance.
Brick Lab is not responsible for costs associated with emergency medical treatment.

4.7 Personal Belongings

Brick Lab is not responsible for lost, stolen, or damaged personal belongings. Participants are encouraged to leave valuable items at home. Brick Lab-provided materials remain the property of Brick Lab unless otherwise specified in the program description.

4.8 Photo & Media Policy

Brick Lab photographs and videos participants during programs for use in class galleries, marketing materials, social media, and promotional content.

Weekly photos from HQ programs are uploaded to a password-protected online gallery accessible to registered Site Members only.
Photos and videos may also be used in Brick Lab marketing materials, flyers, email newsletters, and social media posts.
Opt-Out: Parents or guardians who do not wish for their child's image to be used must notify Brick Lab in writing at BrickLabTeam@SVBrickLab.com. Brick Lab will make reasonable efforts to exclude opted-out participants from published media. Please note that opting out may limit Brick Lab's ability to share program updates or highlights featuring your child's work.
At off-site community events (festivals, vendor events, etc.), Brick Lab staff may photograph participants engaged in activities. These events are held in public spaces where no general expectation of photographic privacy exists. Brick Lab staff will make reasonable efforts to ask permission before photographing individuals, particularly children. The opt-out process described above applies to off-site events as well.
By enrolling in a Brick Lab program or participating in a Brick Lab activity at a public event, you grant Brick Lab a non-exclusive, royalty-free license to use images and video of the enrolled participant for the purposes described above, unless a written opt-out has been received.

5. Program-Specific Terms

5.1 After-School Classes

After-school classes are held at licensed school sites (currently Vine Hill Elementary, Brook Knoll Elementary, and Santa Cruz Montessori) and are open to enrolled students of those schools unless otherwise specified.

Programs are drop-off. Once a participant is released to Brick Lab staff at the start of the program, Brick Lab assumes supervisory responsibility for the duration of the session only.
Brick Lab staff do not provide transportation between school and program locations. Parents and guardians are responsible for ensuring their child arrives at and departs from the program location safely.
Classes are conducted on the school site. Brick Lab staff are not responsible for participants outside of the designated classroom or program space.
School closures, holidays, and minimum days may affect the program schedule. Brick Lab will communicate schedule changes as soon as reasonably possible.

5.2 Camps

Brick Lab week-long and holiday camps are held at Brick Lab HQ, 108 Whispering Pines Dr., Suite 205, Scotts Valley, CA 95066, unless otherwise stated.

Camps are drop-off programs. Brick Lab assumes supervisory responsibility for enrolled participants from the start time to the scheduled end time of each camp day only.
Minimum participant age is 5 years. Brick Lab may, at its sole discretion, accept participants as young as 4 years of age on a case-by-case basis.
Off-Site Activity — Park Walks: Camp programming may include a supervised walk to a nearby park (across the street from Brick Lab HQ). This activity is described in the camp program description at the time of enrollment. By enrolling in camp, the parent or guardian acknowledges and consents to their child's participation in this off-site activity under Brick Lab staff supervision. Brick Lab staff do not provide transportation; the walk is conducted on foot with a staff-to-participant ratio appropriate for the group size.
Full-day camp add-ons (extending the day from 2:00 PM to 5:00 PM) are subject to the same terms as standard camp enrollment.
Brick Lab does not provide meals. Participants should bring their own lunch and snacks unless otherwise stated in the program description.

5.3 Makerspace Programs — Robotics Build Club & Robotics Lab

Robotics Build Club (youth, Thursdays) and Robotics Lab (all ages, Saturdays) are held at Brick Lab HQ.

Robotics Build Club is a drop-off program for participants ages 5–12. Brick Lab assumes supervisory responsibility during the session only.
Robotics Lab is an open-format program. Adult participants and families with children attend together. Brick Lab staff facilitate activities but do not provide childcare. Adults are responsible for the children in their care at all times.
Advanced enrollment is required for Robotics Build Club. Walk-in enrollment for Robotics Lab may be available subject to capacity.

5.4 Parent's Night Out

Parent's Night Out (PNO) is held monthly on the second Friday of each month, 5:00 PM – 9:00 PM, at Brick Lab HQ. PNO is designed as a drop-off enrichment program for children ages 5–12. It is not a childcare or babysitting service.

PNO is a drop-off program. Parents and guardians are expected to drop off and depart. Brick Lab staff assume supervisory responsibility for enrolled participants from 5:00 PM to 9:00 PM only.
Minimum participant age is 5 years. Brick Lab may, at its sole discretion, accept participants as young as 4 on a case-by-case basis.
Each PNO session includes a themed LEGO® make-and-take project, LEGO® movies, building challenges, and supervised imaginative play. Pizza, snacks, and drinks are included.
Emergency contact information is required at enrollment. Parents must be reachable by phone during the entire PNO session.
The late pick-up policy (Section 4.5) applies. Participants not collected by 9:10 PM will begin to accrue late pick-up fees.
Brick Lab is not responsible for participants before drop-off or after pick-up. PNO is not a licensed childcare program. Parents who require licensed childcare should seek an appropriately licensed provider.

5.5 Community Build Night

Community Build Night is held monthly on the third Friday of each month, 5:00 PM – 9:00 PM, at Brick Lab HQ. This is a family event — adults are required to remain present for the duration.

Community Build Night is not a drop-off program. Each child participant must be accompanied by a responsible adult (18+) who remains on-site for the entire event.
Brick Lab staff facilitate activities and ensure a positive experience, but do not assume supervisory responsibility for children during this event. Accompanying adults are responsible for their children at all times.
All ages are welcome. The program includes collaborative LEGO® builds, games, and free creative time.

5.6 Birthday Parties & Private Events

Birthday parties and private group events are subject to the Brick Lab Birthday Party Service Agreement, which is provided separately at the time of booking and constitutes a binding agreement between the Client and Brick Lab.

The Service Agreement governs all party-specific terms including deposits, payment schedules, package inclusions, guest counts, and cancellation terms.
In the event of a conflict between these Terms and the Service Agreement, the Service Agreement controls with respect to the party or private event.
General terms in this document — including the Code of Conduct (Section 4.3), Photo & Media Policy (Section 4.8), and Liability terms (Section 7) — apply to all parties and private events.
Cancellation: Birthday party cancellations are governed by the Service Agreement. For reference, the standard policy is: 14+ days before the event — refund of refundable deposit (25% of total fee); 7–13 days — 50% of refundable deposit; less than 7 days — no refund.

5.7 Off-Site & Vendor Events

Brick Lab periodically participates in community festivals, markets, and public events as a vendor or activity provider. The following terms apply to all such off-site events.

Off-site events are open-access, activity-based events. Brick Lab staff facilitate LEGO® activities and interact with participants, but do not provide childcare, supervision, or any form of custodial responsibility.
Parents and guardians are responsible for their children at all times at off-site events. The presence of a Brick Lab activity booth does not create a supervisory relationship between Brick Lab staff and any child participant.
Brick Lab does not pre-sell access, tickets, or wristbands for off-site events. Participation is at the discretion of the event organizer and Brick Lab staff on the day of the event.
In the event that an off-site event is cancelled, postponed, or modified by the event organizer, Brick Lab is not liable for any inconvenience or costs incurred by attendees. No refunds are applicable as no advance payment is collected by Brick Lab for off-site events.
Brick Lab's liability at off-site events is limited to harm directly caused by the gross negligence or willful misconduct of Brick Lab staff during a Brick Lab-facilitated activity.

5.8 Lego® Lounge

Lego® Lounge is a drop-in, self-directed hangout space for middle and high school students, held at Brick Lab HQ, 108 Whispering Pines Dr., Suite 205, Scotts Valley, CA 95066, Monday, Tuesday, Thursday, and Friday from 2:30 PM – 5:00 PM, and Wednesday from 12:30 PM – 5:00 PM.

Eligibility: Lego® Lounge is intended for participants ages 11–18 (middle school and high school age).
Not Childcare or Tutoring: Lego® Lounge is a recreational rec-space program, similar to a teen center — it is not a childcare, babysitting, tutoring, or homework-help service, and is subject to Section 1.4 above. Staff on site provide general supervision of the space, process payments (including for optional snacks), and enforce the Code of Conduct and posted Lego® Lounge rules. Staff do not provide academic assistance, structured programming, one-on-one support, or any form of custodial care.
Format & Access: Lego® Lounge may be accessed on a drop-in (pay-per-visit) basis or through a paid membership/punch pass, as described on the Brick Lab website. Activities may include open LEGO® building, video games, and unstructured socializing.
Self Check-In / Check-Out: Participants check themselves in and out of Lego® Lounge. No parent or guardian signature, presence, or notification is required for a participant to check out or leave. By enrolling a participant in, or otherwise permitting a participant to attend, Lego® Lounge, the parent or guardian authorizes the participant to arrive at and depart the premises independently, at any time during posted hours, without a parent, guardian, or other authorized adult present or notified.
No Forced Retention: Brick Lab will not require, restrain, or compel any participant to remain on the premises against their will. A participant who chooses to leave before a parent or guardian arrives will be permitted to do so.
Scope of Supervision: Because participants may arrive and depart independently, Brick Lab's supervisory responsibility for a given participant begins when that participant checks in and ends immediately upon that participant's check-out or departure from the premises, whichever occurs first, regardless of whether a parent or guardian has arrived. Brick Lab is not responsible for a participant's safety, whereabouts, or conduct once they have left the premises. Parents and guardians are solely responsible for their child's transportation to and from Lego® Lounge and for their child's whereabouts and safety outside of checked-in time.
Snacks: Snacks and drinks are available for purchase on-site at the participant's own expense. Brick Lab does not guarantee that any snack item is free of allergens or particular ingredients; participants and parents/guardians are responsible for reviewing ingredient information before purchase.
Code of Conduct: In addition to Section 4.3, participants are expected to be respectful of the Lego® Lounge space and to follow all posted and verbally communicated rules. A participant who is harmful, damaging, or disruptive to the space, staff, or other participants may be asked to leave immediately and may be subject to the conduct-related terms of Section 4.3, including dismissal without refund and denial of future access.
Brick Lab-provided equipment, including video game systems and LEGO® materials, remains the property of Brick Lab (see Section 4.7) and must be used respectfully; participants may be held responsible for intentional damage.
The Late Pick-Up Policy (Section 4.5) does not apply to Lego® Lounge.

6. Memberships

6.1 Membership Tiers

Brick Lab offers the following membership tiers:

Site Member (Free): Required to access class galleries, earn Brick Points (while active), and receive special offers and program updates.
Cubby Membership: Paid membership providing access to Makerspace programs at a reduced rate. See current pricing at www.SVBrickLab.com.
Monthly Plans: Paid monthly membership providing access to after-school and Makerspace programs at reduced or no additional cost.
Yearly Plans: Paid annual membership providing the same benefits as Monthly Plans at a discounted annual rate.

6.2 Membership & Program Enrollment

Paid memberships cover most programs, excluding camps, unless otherwise specified.
Membership must be active at the time of participation. If a membership lapses or is cancelled, standard non-member rates apply to any future sessions.
If a client cancels a paid membership before the final session of a multi-session program (e.g., after-school classes), they will be charged $50 per session for each remaining session after the membership expiration date.
Single-session event enrollment using a membership requires the membership to be active at the time of the event.

6.3 Membership Cancellation

Memberships may be cancelled at any time through the Brick Lab website or by contacting BrickLabTeam@SVBrickLab.com.
Cancellation of a membership does not entitle the client to a refund of membership fees already paid, except as required by applicable law.

7. Loyalty Program — Brick Points

NOTICE: The Brick Points loyalty program is being discontinued. All Brick Points will expire on December 31, 2026. Points not redeemed by this date will expire with no compensation or conversion.

7.1 Eligibility & Earning

Only registered Site Members in good standing who have participated in a paid program may earn Brick Points.
Brick Points are non-transferable, have no monetary value, and may only be redeemed for discounts on eligible programs as outlined on the Brick Lab website.
Current clients receive 50 Brick Points for each eligible new client referral. Referred families must be new to Brick Lab, inform Brick Lab of the referral during enrollment or within 7 days, become Site Members, and complete a paid program in full. Points may be rescinded if these requirements are not fulfilled.

7.2 Program Sunset

The Brick Points program will be discontinued effective December 31, 2026.
All accumulated Brick Points must be redeemed prior to December 31, 2026.
On January 1, 2027, all remaining Brick Points will expire with no compensation, conversion, or credit of any kind.
Brick Lab will make reasonable efforts to notify active members of the program discontinuation in advance of the expiration date.

8. User Content & Intellectual Property

8.1 User Content

Any content submitted by users through the Brick Lab website or social media channels — including photos, comments, reviews, or forum posts — may be used by Brick Lab for promotional, educational, or operational purposes. By submitting content, you grant Brick Lab a perpetual, royalty-free, non-exclusive license to use, modify, and share that content. Brick Lab reserves the right to remove any content deemed inappropriate, offensive, or inconsistent with our community standards, at our sole discretion.

8.2 Proprietary Rights

All materials on the Brick Lab website, including images, videos, curriculum designs, lesson plans, and written content, are the property of Brick Builds Co. and are protected by applicable intellectual property laws. Reproduction, distribution, or use of any Brick Lab materials without express written permission is prohibited.

8.3 LEGO® Trademark Notice

LEGO® is a registered trademark of the LEGO® Group of companies. Brick Lab is not affiliated with, sponsored by, or endorsed by the LEGO® Group. All references to LEGO® are made for descriptive purposes only.

9. Website Use

9.1 Disclaimer of Warranty

The Brick Lab website and its content are provided "as is" without warranty of any kind, express or implied. Brick Lab does not guarantee the accuracy, completeness, or reliability of any information on the website. Program availability, pricing, and scheduling are subject to change without notice.

9.2 User Conduct

Users of the Brick Lab website and community forum must not post or share material that is unlawful, offensive, harmful, defamatory, or that violates the rights of any third party. Brick Lab reserves the right to restrict access or remove content as necessary.

10. Liability & Indemnification

10.1 Limitation of Liability

To the fullest extent permitted by applicable law, Brick Lab, its owners, staff, and representatives shall not be liable for any direct, indirect, incidental, or consequential damages arising from participation in any Brick Lab program, use of the Brick Lab website, or attendance at any Brick Lab event.

Brick Lab is not liable for injuries, illness, or incidents that occur outside of scheduled program hours, or that result from a participant's failure to follow staff instructions or program guidelines.

10.2 Inherent Risk

Participation in Brick Lab programs involves physical activity, use of small building components, and in the case of camps, supervised off-site walks. By enrolling a participant, the parent or guardian acknowledges and accepts these inherent risks and agrees that Brick Lab's liability is limited to harm directly caused by the gross negligence or willful misconduct of Brick Lab staff.

10.3 Indemnification

The Client agrees to indemnify, defend, and hold harmless Brick Builds Co., its owners, employees, contractors, and representatives from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) the Client's or participant's use of Brick Lab services; (b) any breach of these Terms by the Client; or (c) the Client's or participant's violation of any applicable law or the rights of any third party.

11. Communication Policy

For general questions or program inquiries, please contact Brick Lab by email at BrickLabTeam@SVBrickLab.com or by phone at 831-337-0602. We strive to respond within 2 business days.

Program staff may not be available to address individual concerns during active program sessions. Please direct all administrative, billing, or enrollment inquiries to the main contact email.

Brick Lab may contact enrolled clients via email to share program updates, scheduling changes, special offers, and news. Clients may opt out of marketing communications at any time by emailing BrickLabTeam@SVBrickLab.com or using the unsubscribe link in any marketing email. Transactional and program-related communications (e.g., enrollment confirmations, schedule changes) are not subject to opt-out.

12. Acknowledgment

By enrolling in a Brick Lab program, making a purchase through the Brick Lab website, or participating in a Brick Lab activity, the Client acknowledges that they have read, understood, and agreed to these Terms and Conditions in their entirety.
