Acceptance of Terms: Use of The Brick Lab website (the "Site") constitutes acceptance of these terms and conditions (the "Terms").

Modification of Terms: The Brick Lab reserves the right to modify the Terms at any time without prior notice. Your continued use of the Site following any such modification constitutes your acceptance of the modified Terms.

User Content: The Site may allow users to post, upload, or otherwise transmit content (“User Content”). You retain all rights in and to your User Content. By submitting User Content, you grant The Brick Lab a non-exclusive, transferable, sub-licensable, royalty-free, perpetual, irrevocable right to use, copy, modify, distribute, and display such User Content in connection with the Site and The Brick Lab’s business.

Final Determination of Inappropriate User Content: The Brick Lab reserves the right, but not the obligation, to monitor User Content and to remove any User Content that violates these Terms or is otherwise deemed inappropriate by The Brick Lab at its sole discretion. The Brick Lab's determination as to what constitutes inappropriate User Content is final.

Proprietary Rights: The Site and its content, including but not limited to text, software, scripts, graphics, photos, sounds, music, videos, and interactive features, are protected by intellectual property laws, including but not limited to copyright and trademark laws.

User Conduct: You agree not to use the Site to upload, post, or otherwise transmit any material that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable.

Disclaimer of Warranty: The Site and its content are provided on an "as is" and "as available" basis. The Brick Lab makes no representation or warranty of any kind, express or implied, regarding the use or the results of the Site in terms of its accuracy, reliability, or otherwise.

Limitation of Liability: The Brick Lab shall not be liable for any damages of any kind arising from the use of the Site, including but not limited to direct, indirect, incidental, punitive, and consequential damages.

Indemnification: You agree to indemnify and hold The Brick Lab and its affiliates, officers, agents, and employees harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the Site, your User Content, or your violation of these Terms.

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the state of California, without giving effect to any principles of conflicts of law.

Dispute Resolution: Any dispute arising under or in connection with these Terms shall be resolved through binding arbitration in accordance with the Superior Courts of California County of Santa Cruz rules.
Photo Policy

All photos, images, videos, and all other media on this website are the property of The Brick Lab and are protected by copyright laws.

Unauthorized use, reproduction, or distribution of any photos, images, or media is strictly prohibited and may result in legal action.

Explicit permission must be obtained, in writing, from The Brick Lab for any use of media, including but not limited to reproduction, display, or distribution.

The Brick Lab may use third-party photos with proper licensing agreements. Any use of third-party photos will be properly credited to the original source when required.

Any third-party use of The Brick Lab's photos must properly credit The Brick Lab as the source.

The Brick Lab reserves the right to revoke permission at any time.

The Brick Lab assumes no liability for any unauthorized use of the photos by third-parties.
Additional Terms and Conditions for The Brick Lab After School Program

Introduction: The Brick Lab is an after-school program for children aged 5 to 12 years. This program aims to provide children with opportunities to learn, play, and grow in a safe and nurturing environment. The terms and conditions set out in this agreement are intended to ensure that the program is run safely and effectively for the benefit of all participants. In this document, the parent/guardian/primary caregiver shall be referred to as "the client," in these terms and conditions.

Scotts Valley Unified School District Rules and Regulations: The Brick Lab operates within the facilities of the Scotts Valley Unified School District and is required to comply with all rules and regulations related to enrollment and facility use. The client agrees to ensure that their child complies with these rules and regulations and acknowledges that any violation of these rules may result in the child being expelled from the program.

Enrollment: To enroll in The Brick Lab, the client must complete the enrollment form and pay the required fees. The enrollment form must be completed accurately and completely, and all information must be up-to-date. The client must also provide written consent for their child to participate in the program, including consent for any necessary medical treatment.

Program Fees: The fees for The Brick Lab are set out in the enrollment form and are subject to change without notice. Payment of fees must be made in full, and on time, to secure a place in the program. Late payment of fees may result in the child being unable to participate in the program.

Program Attendance: The client must ensure that their child attends the program regularly and on time. If a child is unable to attend, the client must inform The Brick Lab as soon as possible. Repeated absence from the program may result in the child’s place being forfeited.

Safety and Conduct: The Brick Lab is committed to providing a safe and enjoyable program for all participants. The client must ensure that their child behaves appropriately and follows the rules set out by The Brick Lab. Inappropriate behavior may result in the child being excluded from the program. The Brick Lab reserves the right to expel a child from the program for any reason it deems necessary, including but not limited to, repeated unacceptable behavior or failure to adhere to the terms and conditions of this agreement.

Liability: The Brick Lab is not responsible for any loss or damage to personal property, or for any injury sustained during the program. The client is advised to ensure that their child has appropriate insurance coverage for any losses or injuries that may occur.

Privacy: The Brick Lab respects the privacy of all participants and will not share personal information with any third parties without written consent. To view The Brick Lab’s full Privacy Policy please visit www.SVBrickLab.com/privacy-policy.

Medical Treatment: The client agrees to allow The Brick Lab to provide necessary medical treatment to their child in case of any injury or illness that may occur during the program. The Brick Lab will make reasonable efforts to contact the client in case of an emergency, but in the absence of contact, The Brick Lab may take appropriate action to ensure the child receives the necessary medical treatment.

Photo Policy: The Brick Lab may take photographs or videos during the program for promotional purposes. The client may request in writing that their child’s image not be used. If the client does not object to the use of their child’s image, they agree to its use in promotional materials, including but not limited to, brochures, websites, and social media. PLEASE NOTE: If the client requests their child’s image not to be used then The Brick Lab will be unable to use photos or videos to communicate with the client in regard to their student’s progress, projects, or activities.

Cancelation: All cancelations for The Brick Lab after school programs must be done in writing by email sent to: info@svbricklab.com. Cancelation emails must contain the name of the enrolled student, the program they are currently enrolled in, and the reason for cancelation. To receive a full refund, cancelation emails must be received no later than 3 business days prior to the start of a multi-week session. Cancelation emails received 1-2 business days prior to the start of a multi-week session will receive a 75% refund. While cancelation emails received after the start of a multi-week session will receive only a 50% prorated refund (i.e., the total cost of the enrollment will be divided by the total number of weeks, this number will then be multiplied by the number of class sessions remaining; 50% of that number will be refunded).

Changes to the Terms and Conditions The Brick Lab reserves the right to change the terms and conditions of this agreement at any time. The client will be notified of any changes in writing.
By enrolling in The Brick Lab After School Program, the client acknowledges that they have read and understood the terms and conditions of The Brick Lab after-school program and agree to abide by them.

Loyalty Program – Brick Points
​
The Brick Lab currently provides a Loyalty Program to current clients (defined as the caregiver of a student who has already enrolled in or completed a Brick Lab program or booked and paid for a Brick Lab service or a person over the age of 18 who has experience with or in-depth knowledge about The Brick Lab) as a thank you for their repeat business. The Loyalty Program, known as Brick Points, is a system by which current clients can earn points which can be redeemed with The Brick Lab for discounts on company programs.

Brick Points have no monetary value and cannot be redeemed or traded in for cash or credit. Brick Points can ONLY be applied toward discounts on specified Brick Lab programs and/or services as detailed on our website on the Brick Points page. Occasionally The Brick Lab may run promotions allowing current clients to redeem Brick Points for Brick Lab merchandise or products; but this should in no way be construed as Brick Points having any type of monetary value. Available discounts, eligible services, eligible programs, or eligible products may be changed without notice, and it is at the sole discretion of The Brick Lab to apply Brick Points towards earned discounts or items.

To begin earning Brick Points the following requirements must be met:

Brick Points are only given to current clients who are site members. Only members of our website will be able to earn Brick Points. Becoming a site member can easily be done on the website by clicking on “Log In/Sign Up” in the upper right-hand corner of the Home screen or by visiting the Forum page.

No purchase is necessary. Current clients can earn Brick Points through special promotions, becoming a site member, referring new clients, and a variety of other ways. However, each method of earning Brick Points requires adherence to a specific set of requirements as described on our website or within these Terms and Conditions.

Current clients must be in “good standing” within our Forum as a site member. Good standing is defined as exhibiting appropriate and respectful online behavior within our Forum and communicating with The Brick Lab Team in a respectful way. Good standing status is provided at the sole discretion of The Brick Lab. Because site members who are not in good standing may still be allowed to view the Forum, simply being a site member does not automatically qualify a current client to earn Brick Points. Any current client not in good standing will be informed of this change in their status via email from bricklabteam@svbricklab.com.

Any other requirements that The Brick Lab Team may deem necessary based on a current client’s past behavior, client status, or work relationship with The Brick Lab. In such a case, The Brick Lab Team will inform the current client of these new requirements via email from bricklabteam@svbricklab.com.
While The Brick Lab Team will do their best to uphold Brick Point policies and distribution in accordance with the information published on our website and within these Terms and Conditions there are always instances that occur which our Team cannot plan for. If our Team feels, for any reason, that Brick Points should not be issued, even if all requirements have ben met, then Brick Points can be denied to a current client at the sole discretion of The Brick Lab. The inverse is also true, and 50 Brick Points may be awarded once to any current client who mentions this passage to our Team in an email. Thanks for reading the Terms and Conditions.

Refer-A-Friend Program

Current clients (defined as the caregiver of a student who has already enrolled in or completed a Brick Lab program or a person over the age of 18 who has experience with or in depth knowledge about The Brick Lab) may earn Brick Points by referring new clients (defined as a student or the caregiver of a student who has never enrolled in, participated in, or completed a Brick Lab program) to an after school program offered by the Brick Lab. The awarding of Brick Points both to the current client and the new client is at the sole discretion of The Brick Lab.

Current clients will be awarded 50 Brick Points for every new client they refer to our after school programs. To receive the 50 Brick Points the following requirements must be met:

The new client must genuinely be a new client. This means they have never previously enrolled in, participated in, or completed one of our after school programs or booked a party with The Brick Lab. If a client has paid any monies or made any program or service booking with The Brick Lab then they are considered a current client and do not qualify as a referral.

The new client MUST inform The Brick Lab that they are a referral. This can be done in one of two ways:

At the time of enrollment, the referred new client may enter the name of either the current client or the current client’s student in the appropriate field.

Within seven days of enrolling, or prior to enrolling, the new client may send an email to bricklabteam@svbricklab.com or communicate through the Contact Us form on The Brick Lab website to inform our team that they have been referred by a current client. The email or website communication must include their own name, the name of their student, the program they enrolled in (or intend to enroll in) and the name of the current client who referred them.

BOTH the current client and new client MUST be site members with The Brick Lab through our website. Only members of our website will be able to earn Brick Points. This can easily be done on the website by clicking on “Log In/Sign Up” in the upper right-hand corner of the Home screen or by visiting the Forum page.

Before 50 Brick Points can be awarded to either the referring current client or the referred new client the new client must complete their enrollment, pay for the program in full, and have no refunds, discounts, or partial refunds issued to them in association with their first enrollment. This does not apply to any promotions being offered by The Brick Lab. For example:

If a new client is referred, follows requirements 1-3 and attends the first 2 sessions of an after school program but then withdraws and is issued a partial refund, no Brick Points will be awarded to either the new or current client.

If a current client informs a new client of a discount promotion currently being offered by The Brick Lab and the new client enrolls, receives the discount, and completes all sessions of the program, both the new and current client will receive the 50 Brick Points.

Brick Points may be issued as early as the first week after a new client enrolls with The Brick Lab or as late as one week after the completion of a new client’s first full (8-week) program. This is done at the sole discretion of The Brick Lab. In the event that Brick Points have been issued to either a new client or current client but one of the above-mentioned requirements is not fulfilled then The Brick Lab may rescind issues Brick Points from either or both the new and/or current client.

While new clients are only eligible to earn 50 Brick Points once per each of their enrolling students (enroll one student, earn 50 brick points; enroll 3 students, earn 150 Brick Points) there is NO LIMIT to the number of Brick Points a current client can earn as long as all the above-mentioned requirements are met. A new client becomes a current client and can start earning Brick Points through referring new clients once they have enrolled in any Brick Lab program or service and have become a site member.

Entire Agreement: These Terms constitute the entire agreement between you and The Brick Lab regarding the use of the Site, promotions, services, and/or after school program. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
